RENTAL WAIVER, RELEASE OF LIABILITY, & TERMS

This agreement is between the undersigned participant (or parent/legal guardian of a minor) and Doomsday Skate / Everyone Rolls (“Company”), including its owners, staff, volunteers, partners, and venue hosts.

PLEASE READ CAREFULLY — THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS 

1. PARTIES 

This agreement is between the undersigned participant (or parent/legal guardian of a minor) and Doomsday Skate / Everyone Rolls (“Company”), including its owners, instructors, staff, volunteers, contractors, event partners, sponsors, and property/venue hosts. 

2. ASSUMPTION OF RISK 

I understand that roller skating and use of rental equipment involve inherent and other risks, including but not limited to: falls, collisions, uneven surfaces, equipment malfunction, and negligence of myself or others, which may result in serious injury, disability, or death. 

I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Company, except to the extent prohibited by California law. 

3. RELEASE OF LIABILITY

To the fullest extent permitted by California law, I release, waive, and discharge the Company from any and all claims, demands, causes of action, damages, or liability for injury, death, or property damage arising out of or related to my participation and/or use of rental equipment, including claims based on the alleged negligence of the Company. 

4. INDEMNIFICATION & HOLD HARMLESS 

I agree to indemnify, defend, and hold harmless the Company from any claims, liabilities, damages, costs, or attorneys’ fees arising from my participation, my use or misuse of equipment, or my breach of this agreement. 

5. EQUIPMENT USE & RESPONSIBILITY 

I agree that: 

I am responsible for all rented equipment issued to me 

I will inspect equipment prior to use and notify staff of any issues 

I will use equipment properly and follow all instructions 

I will return equipment by the designated time 

6. LOSS, THEFT, OR DAMAGE 

I accept financial responsibility for lost, stolen, or damaged equipment beyond normal wear, and authorize the Company to charge reasonable replacement or repair costs if applicable. 

7. FITNESS TO PARTICIPATE 

I certify that I am physically able to participate and have no condition that would make participation unsafe. I agree to stop if I feel unsafe. 

8. RULES & CONDUCT 

I agree to follow all posted rules and staff directions. The Company reserves the right to refuse service or remove participants for unsafe behavior.

9. MINORS (REQUIRED FOR UNDER 18) 

If signing for a minor, I certify I am the parent/legal guardian and: 

Consent to the minor’s participation 

Agree to all terms on the minor’s behalf 

Accept full responsibility for the minor’s actions and risks 

10. PHOTO & MEDIA RELEASE 

I grant permission for photos/videos taken at the event to be used for marketing without compensation. 

11. NO REFUNDS 

Rental fees are non-refundable. 

12. SEVERABILITY 

If any provision is found unenforceable, the remaining provisions shall remain in full force. 

13. GOVERNING LAW & VENUE 

This agreement shall be governed by the laws of the State of California, with venue in the appropriate courts of Santa Barbara County or the event county. 

14. ACKNOWLEDGMENT 

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND IT, AND SIGN IT VOLUNTARILY. I UNDERSTAND I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.
